H-1B Cap Exemptions and Alternatives to the Lottery

Most people who need a new H-1B have to go through a lottery. A much smaller group does not. This page explains which employers and which jobs sit outside the annual H-1B numerical limit, which workers have already been counted and so are not counted again, and which visa categories let nationals of a few countries avoid the lottery altogether.

What are the Special Regional Center Provisions?

Most EB-5 investors today do not go out and run a business of their own. They invest through a regional center, a USCIS-designated entity that sponsors projects and pools capital from a number of immigrant investors. Congress created this route in 1992 as a pilot and has kept it alive by periodic reauthorization ever since. The EB-5 Reform and Integrity Act of 2022 rebuilt it, and immigrant visas are currently authorized under the Regional Center Program through September 30, 2027.

According to the Atlanta Journal-Constitution on 12/6/06, Georgia State Senator Curt Thompson's wife will not be deported out of the U.S. after all. A deportation order was entered against the Colombian national, however, apparently as a result of shoddy work by a "notario". The Atlanta Journal-Constitution reported that the ordeal began as follows:

Federal immigration agents knocked on the door of state Sen. Curt Thompson's home in Tucker on Nov. 28 and informed him his new bride was to be deported.
