Temporary Protected Status

Temporary Protected Status (TPS) is the primary "protected status" which the U.S. government grants to eligible individuals from certain designated countries, authorizing them to remain in the U.S. for a certain period of time.

Note that you do not necessarily have to be a citizen of the designated country to qualify for TPS. An individual having no nationality in the designated country but who last habitually resided in that country may also be eligible for TPS.

The USCIS describes TPS as follows: "Temporary Protected Status (TPS) is a temporary immigration status granted to eligible nationals of designated countries. TPS beneficiaries will not be required to leave the United States and may obtain work authorization for the initial TPS period and for any extensions of the designation. TPS does not lead to permanent resident status. When the Secretary of Homeland Security (Secretary) terminates a TPS designation, beneficiaries will return to the same immigration status they had before TPS (unless that status has expired or has been terminated) or to any other status they may have been granted while in TPS."

Countries (or parts thereof) which are currently designated (as of 27-July-2006) under the TPS program are listed below (with links to USCIS information page):

Burundi: TPS re-registration period ended November 1, 2005.
DHS Announces 12-Month Extension of Temporary Protected Status (TPS) for Nationals of Burundi until 2-NOV-2007

The U.S. Department of Homeland Security (DHS) announced a 12-month extension of Temporary Protected Status (TPS) for nationals of Burundi until November 2, 2007. DHS notes that "DHS also automatically extended the validity of Employment Authorization Documents (EADs) held by eligible Burundians for an additional six months until May 2, 2007." The DHS Press Release of September 14, 2006 is attached in PDF. The main text of the DHS Press Release appears below:

------------------------------------------

DHS Announces 12-Month Extension of Temporary Protected Status (TPS) For Nationals of Burundi

Employment Authorization Documents (EADs) Extended Six Months through May 2, 2007

WASHINGTON – The Department of Homeland Security (DHS) announced today a 12-month extension of Temporary Protected Status (TPS) for nationals of Burundi until November 2, 2007. Under this extension, those who have already been granted TPS are eligible to live and work in the United States for an additional 12 months and continue to maintain their status. DHS also automatically extended the validity of Employment Authorization Documents (EADs) held by eligible Burundians for an additional six months until May 2, 2007. This will allow sufficient time for eligible TPS beneficiaries to receive their new EAD without any lapse in employment. There are approximately 27 nationals of Burundi (or aliens having no nationality who last habitually resided in Burundi) who are eligible for re-registration.

The extension of TPS for Burundi is effective November 2, 2006 and will remain in effect through November 2, 2007. Nationals of Burundi who have been granted TPS must re-register for the 12-month extension during the 60-day re-registration period beginning September 14, 2006 and remaining in effect until November 13. Burundi TPS beneficiaries are encouraged to apply as soon as possible following the start of the 60-day re-registration period.

To re-register for TPS under the extension, a TPS beneficiary must submit Form I-821 (Application for Temporary Protected Status) without the filing fee and Form I-765 (Application for Employment Authorization). If the applicant is only seeking to re-register for TPS and not seeking an extension of employment authorization, he or she must submit Form I-765 for data-gathering purposes only but is not required to submit the I-765 filing fee. All applicants seeking an extension of employment authorization until November 2, 2007 must submit a $180 filing fee with Form I-765. The $70 biometric service fee must be submitted by all re-registrants age 14 and older, as well as re-registrants under age 14 who are requesting an EAD. Applicants may request a fee waiver in accordance with the regulations. The biometric fees, however, cannot be waived. Failure to submit the required filing fees will result in the rejection of the re-registration application.

****

‹ Who is Eligible for Temporary Protected Status?upU.S. Citizenship ›
